Terms & Privacy

Section 01

Overview

These Terms of Service ("Terms") govern your use of services provided by Top Class Elevate ("we," "our," or "the Company"), operating in the Province of Ontario, Canada. By requesting, booking, or receiving any of our services, you agree to be bound by these Terms.

Top Class Elevate operates four service divisions: HVAC, Snow Removal, Lawn Care & Landscaping, and Renovation & Construction. These Terms apply to all divisions unless otherwise specified in a written service agreement.

These Terms constitute a legally binding agreement between you (the client) and Top Class Elevate. If you do not agree to these Terms, please do not engage our services.

Section 02

Services

Top Class Elevate provides the following categories of services within the All of Ontario and surrounding municipalities:

We reserve the right to decline any project or service request at our sole discretion. Services are subject to availability and geographic coverage.

Section 03

Quotes & Pricing

All quotes provided by Top Class Elevate are free of charge and carry no obligation to proceed. Quotes are valid for 30 days from the date of issuance unless otherwise stated in writing.

  • Written quotes outline the full scope of work, materials, labour, and applicable taxes.
  • Verbal estimates are not binding. Only written, signed quotes constitute a firm price.
  • Project scope changes requested by the client after a quote is accepted may result in a revised quote and adjusted pricing.
  • Material price fluctuations beyond our control (lumber, HVAC equipment, etc.) may affect final pricing if project start is delayed more than 30 days after quote acceptance.
  • All prices are in Canadian dollars and exclude applicable HST (13%) unless explicitly stated as tax-inclusive.

We believe in full pricing transparency. If anything changes during a project, we will notify you in writing and obtain your approval before proceeding with any additional costs.

Section 04

Payments

Payment terms vary by service type and project size:

Accepted payment methods include e-Transfer, credit card, cheque, and cash. A 1.5% monthly interest charge (18% annually) will be applied to any outstanding balances more than 30 days past due.

Top Class Elevate reserves the right to suspend services or halt active projects for accounts with outstanding unpaid balances.

Section 05

Scheduling & Service Delivery

We make every reasonable effort to arrive within the agreed service window. However, the following conditions may affect scheduling:

  • Weather: Extreme weather conditions may delay or reschedule non-emergency services. Snow removal and HVAC emergency services are prioritized during weather events.
  • Access: The client is responsible for ensuring our crew has safe, clear access to the work area. Delays caused by restricted access may result in rescheduling fees.
  • Permits: Where permits are required (renovation, construction), timelines are subject to municipal approval processes outside our control.
  • Emergencies: HVAC and snow removal emergencies are responded to on a 24/7 basis, subject to crew availability. Response times are estimated but not guaranteed.

You will receive a notification when our crew is en route, and again upon job completion for applicable services.

Section 06

Cancellation & Rescheduling

Our cancellation policy is designed to be fair to both clients and our crew:

  • Lawn Care & Snow Removal (per-visit): Cancellations with less than 24 hours notice may be charged the full visit fee.
  • Seasonal Contracts: Seasonal agreements may be cancelled with 30 days written notice. Refunds are prorated based on services rendered to date, minus a $75 administrative fee.
  • HVAC & Renovation Projects: Cancellation after work has begun will result in invoicing for all work completed and materials ordered or purchased to date. Deposits are non-refundable once materials have been ordered.
  • Emergency Services: Emergency callouts that are cancelled after dispatch may be charged a callout fee of up to $150.

Section 07

Warranty & Workmanship

Top Class Elevate stands behind every job we complete. Our warranty coverage is as follows:

Warranty coverage is void if damage results from misuse, unauthorized modifications, acts of nature, or failure to maintain systems as recommended. Warranty claims must be submitted in writing to info@topclasselevate.ca.

Section 08

Limitation of Liability

Top Class Elevate carries $5,000,000 in commercial general liability insurance and maintains WSIB coverage for all employees and subcontractors.

Notwithstanding the above, our total liability to any client for any claim arising out of or related to our services shall not exceed the total amount paid by the client for the specific service that gave rise to the claim.

We are not liable for:

  • Pre-existing property conditions, structural defects, or hidden damage discovered during work
  • Damage caused by factors outside our control (extreme weather, acts of God, utility failures)
  • Indirect, consequential, or incidental damages of any kind
  • Delays caused by permit approvals, material shortages, or supply chain disruptions
  • Damage resulting from client failure to follow post-service care instructions

We are fully insured and take every precaution to protect your property. Any damage caused directly by our crew will be addressed promptly through our insurance provider.

Section 09

Privacy Policy

Top Class Elevate is committed to protecting your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario privacy legislation.

We collect personal information for the following purposes:

  • Processing service requests and quotes
  • Scheduling and dispatching crews to your property
  • Sending service notifications and appointment reminders
  • Processing payments and maintaining billing records
  • Communicating service updates, promotions, and seasonal reminders
  • Improving our services based on client feedback

We do not sell, rent, or trade your personal information to third parties. Information is shared only with trusted service partners (payment processors, scheduling software) strictly necessary to deliver our services.

Section 10

Your Data & Rights

Under PIPEDA and applicable Canadian privacy law, you have the right to:

  • Access — Request a copy of the personal information we hold about you
  • Correction — Ask us to correct inaccurate or incomplete information
  • Withdrawal of consent — Opt out of marketing communications at any time
  • Deletion — Request deletion of your personal data, subject to our legal retention obligations
  • Complaint — File a complaint with the Office of the Privacy Commissioner of Canada if you believe your rights have been violated

To exercise any of these rights, contact us at info@topclasselevate.ca with the subject line "Privacy Request." We will respond within 30 days.

We retain client records for a minimum of 7 years as required by Canadian tax and business law, after which records are securely destroyed.
